Terms & Conditions

These terms form the basis of the contract between the customer and Houston Cakes Ltd.

Booking and Final Payment

At the time of booking a non-refundable deposit of 50% will be taken, this secures your date in our cake diary. The remaining balance will be due 1 week before the delivery date for celebration cakes and 1 calendar month before the delivery date for wedding cakes. Payment can be made with cash or bank transfer. In the event of late payment Houston Cakes Ltd reserves the right to cancel the booking or hold the order until full payment is made.

Postponement

In the event of the delivery date requiring postponement we will do our best to accommodate your new date subject to availability. Any monies paid will be carried forwards to the new date. Postponement is allowed only once per order, any further postponements (excluding those imposed by government restrictions) will be classed as a cancellation and no refund will be given. If a customer postpones the delivery date the final balance is subject to increase due to rising equipment/material costs - this will be discussed with the customer at the time of postponement.

Cancellation by the customer

In the event of the customer cancelling the order the 50% booking fee is non-refundable, the remaining balance will not be refunded if the cancellation is within 2 weeks of the delivery date as supplies and materials will have been already purchased.

Cancellation by Houston Cakes Ltd

In the unlikely event of cancellation by Houston Cakes we will either seek to find another reputable cake maker to create your cake (with the customers permission) or a full refund will be given.

Delivery

Delivery is available up to a 30 mile radius from the bakery and is charged at £1.00 per mile. International delivery is not available. We will arrange a suitable delivery time with yourself or your venue however delivery times are a guide only and cannot be guaranteed due to unforeseen events such as road closures, break downs, accidents and traffic. We will always inform the customer/venue of any delays in delivery and encourage customers to allow plenty of time for delivery before their event. We do not accept responsibility for any loss, damage or non-delivery under non-avoidable or exceptional circumstances. for wedding cakes in particular we highly recommend taking out wedding insurance which should protect the consumer in these eventualities.

If the cake is delivered to a venue photographs of the delivered product will be taken at different angles to prove the condition of the product upon delivery. Where possible a signature will be taken from the member of staff the cake is handed over to and full instruction on handling the cake will be provided. After delivery we do not accept any liability for any loss or damage to the cake thereafter nor any failure to follow the instructions given.

Collection

Customers may collect their order free of charge from Houston Cakes Ltd. Advice will be given to each customer on how to safely transport and store their order however the customer accepts all liability and responsibility for the cake once it has left the bakery premises. Houston Cakes Ltd accepts no liability for any damage to the product once it has left the kitchen. 

Please allow plenty of time for collection and estimate your arrival time as accurately as possible, late collection is subject to the the discretion and availability of Houston Cakes Ltd.

Allergens, Intolerances and Dietary Requirements

It is the responsibility of the customer to inform Houston Cakes of any requirements due to allergies or intolerances. Finding out the allergy/dietary requirements of event guests is the responsibility of the customer. As a small domestic bakery we handle and store ingredients including nuts, gluten, soya products, eggs, milk, citrus and alcohol - other allergens may also be present. Whilst every effort is made by Houston Cakes to keep specific allergens clear of the kitchen when advised by the customer we cannot guarantee products are '100% allergen free'. We do not accept liability for any allergic reactions or complications resulting from the consumption of our product and it is the responsibility of the customer to advise anyone consuming the product of the above risk.

 

All ingredients and allergens used are listed on the delivery slip that is provided attached to the cake box upon delivery/collection and are also emailed to the client/venue prior to delivery/collection. This will also include any Non-Edible items which are to be removed by the customer/venue prior to serving - it is the responsibility of the customer to ensure this is undertaken prior to consumption.

Cake Design

By nature cake design is a creative process, at Houston Cakes Ltd we will work as best we can with the customer to agree upon a design. Whilst we will endeavour to meet the customers expectations there are times when the cake designer may need to make small changes to ensure structural integrity or aesthetics. This will not be discussed with the customer unless it will cause a significant change in the final appearance of the product.

Complaints

These are very rare but if they do occur we take them very seriously. Any complaint must be made in writing within 24 hours of receiving the cake, please outline the issue in an email to gemma.houstoncakes@gmail.com. Any refunds given are fully at the discretion of Houston Cakes Ltd and are not automatic, the refund value will never exceed that of the value of the cake. Full refunds (not including the non-refundable booking fee) will never be given for a cake that has been consumed regardless of the dispute, as consumption of the cake is viewed as the customers acceptance that the cake is adequate for the purpose it has been supplied.

Please note that once the booking fee has been paid, you are agreeing to the above terms and conditions.
